Terms of service

1. Scope of Service
[Night N' Day 3d Printing] (the "Service Provider") provides custom additive manufacturing (3D printing) services. All products are fabricated based on digital files or specifications provided by the Customer. As a mainly dual or single-operator business, lead times are estimates and may be adjusted based on machine maintenance or order volume.

2. Design Responsibility & Integrity
  • Customer Warranty: The Customer is solely responsible for the structural integrity and "printability" of the provided design.
  • No Validation: The Service Provider does not validate, engineer, or stress-test models for safety or fitment unless a separate CAD Design Fee has been paid.
  • Tolerances: Due to the nature of FDM/Resin printing, a dimensional variance of ±0.5mm or 1% (whichever is greater) is standard and accepted by the Customer upon ordering.

3. Intellectual Property (IP) & Indemnification
  • Ownership: Service Provider claims no ownership over Customer-supplied files.
  • Infringement Warranty: Customer warrants that they own the rights or have a commercial license for any file submitted.
  • Indemnity: Customer agrees to indemnify, defend, and hold harmless [Night N' Day 3d Printing] from any claims, legal fees, or damages arising from trademark, patent, or copyright infringement related to the Customer's order.

4. Safety & Liability Disclaimer
  • Prohibited Applications: Products are NOT to be used in safety-critical, medical, automotive, aerospace, or load-bearing applications where failure could cause injury or property damage.
  • No Warranties: All items are provided "As-Is." The Service Provider disclaims all warranties, including merchantability or fitness for a specific purpose.
  • Limitation of Liability: In no event shall the Service Provider’s liability exceed the total price paid for the specific order in question.

5. Restricted Content
The Service Provider reserves the right to refuse any order at its sole discretion, including but not limited to:
  • Weapons, firearm components, or functional weapon accessories.
  • Drug paraphernalia or illegal contraband.
  • Obscene or hateful material.

6. Post-Processing & Environmental Care
  • Environment: Customer acknowledges that materials like PLA can warp in high heat (e.g., a hot car). Damage from improper storage is not a manufacturing defect.
  • Modifications: Any sanding, painting, or drilling performed by the Customer voids all claims of manufacturing defects.
